Marshall County Central Dispatch received a call on Friday, May 12th, at about 3:15 in the morning about someone involved in a wreck with their moped in the area of Olive Trail and 12B Road in Plymouth.

Officer Zerbee with the Culver Police Department was first to arrive on the scene. Deputy Haygood and Deputy Johnson with the Sheriff’s Department arrived shortly after and see a man identified as 46-year-old Brian R. Braden Sr. sitting on the moped registered to him.

During the accident investigation, it was believed that Brian Braden was intoxicated. Brian was transported to Plymouth Hospital for treatment and an examination along with a chemical test.

Brian Braden who has a West Jefferson Street address in Plymouth was lodged in the Marshall County Jail on a $5000 cash bond for being a Habitual Traffic Violator (Lifetime) as a Level 5 Felony, Operating a Vehicle While Intoxicated with a blood alcohol content of .15 or more as a Class A Misdemeanor, Public Intoxication as a Class B Misdemeanor and Operating a Vehicle While Intoxicated as a Class C Misdemeanor. 

Readers are reminded that charging information supported by an affidavit of probable cause is merely an allegation that a crime has been committed and that there is only probable cause to believe a crime has been committed. They are presumed innocent throughout the proceedings and are entitled to be represented by counsel and entitled to a trial by jury at which the State is obligated to provide proof beyond a reasonable doubt before a judgment of guilt may be made.
