owi-arrestOfficer Ayala with the Marshall County Sheriff’s Department initiated a traffic stop on a vehicle for speeding Sunday morning, November 24th about 1:15 on Michigan Road near 6C Road.  

The officer made contact with the driver 41 year old Timmy Ellis Howard of Culver.  He was offered the opportunity for standardized field sobriety testing and was then transported to the Hospital where he was offered a chemical test.

Results would later indicate that Timmy Howard was found to be more than three times the legal limit for alcohol.   He was evaluated by medical staff for jail clearance and was then booked into the Marshall County Jail for: Operating a Motor Vehicle while Intoxicated .15% or higher and OWI-Endangerment.  His cash bond was set at $1,500 and he was given a court date of Dec. 10.

 

Listeners and readers are reminded that charging information supported by an affidavit of probable cause is merely an allegation that a crime has been committed and that there is only probable cause to believe a crime has been committed. They are presumed innocent throughout the proceedings and are entitled to be represented by counsel and entitled to a trial by jury at which the State is obligated to provide proof beyond a reasonable doubt before a judgment of guilt may be made.
