Friday morning just after midnight an officer with the Marshall County Police Department stopped a vehicle for an equipment violation at U.S. 31 and U.S. 6. The vehicle was occupied by three subjects, one of which was a juvenile.
During the traffic stop the officer smelled the odor of burnt marijuana coming from the vehicle. A probable cause search of the vehicle found that the juvenile was in possession of marijuana and marijuana paraphernalia.
The driver, later identified as James A. Mc Michael, failed several standard field sobriety tests and later a certified chemical test at the Plymouth Hospital. Mr. Mc Michael was later lodged at the Marshall County Jail for Operating While Intoxicated and Operating While Intoxicated Controlled Substance.
Readers are reminded that charging information supported by an affidavit of probable cause is merely an allegation that a crime has been committed and that there is only probable cause to believe a crime has been committed. They are presumed innocent throughout the proceedings and are entitled to be represented by counsel and entitled to a trial by jury at which the State is obligated to provide proof beyond a reasonable doubt before a judgment of guilt may be made.
