05/13/14 On Friday, May 9th at 2:35 P.M. Plymouth Police Officer Shelly Cleveland responded to Penguin Point in reference to an intoxicated female. Officer Cleveland located the female identified as 21 year old Alexis Tanner of Plymouth in the drive-thru. Tanner was taken into custody for operating a vehicle while intoxicated and resisting law enforcement. She was transported to the ER at Saint Joseph Regional in Plymouth for jail clearance and then transported to the Marshall County Jail and booked on a $3,005 bond. She was released on May 11th with no judicial review and received an May 20th Superior Court II date for her initial hearing.
Later Friday afternoon at 4:47 P.M. during a residential entry investigation Officer Joe Deisch located and arrested 19 year old Ethan Sampson of Plymouth for residential entry. Sampson was transported to the County Jail and held on a $1,505 bond.
On Sunday, May 11th at 3:20 A.M. Officer Chris Miller responded to 1535 North Michigan Street and located 40 year old Jose A. Rivera of Plymouth after an off duty officer followed Mr. Rivera from Mi Camino Restaurant observing erratic driving. Officer Miller conducted a field sobriety test that led to the arrest of Mr. Rivera for operating while suspended with a prior charge and operating a vehicle with a BAC of .08 or more. Mr. Rivera was transported to the County Jail and held on a $755 bond. He was released at 5:00 P.M. after posting bond and received a May 20th Superior Court II date for his initial hearing.
Readers are reminded that charging information supported by an affidavit of probable cause is merely an allegation that a crime has been committed and that there is only probable cause to believe a crime has been committed. They are presumed innocent throughout the proceedings and are entitled to be represented by counsel and entitled to a trial by jury at which the State is obligated to provide proof beyond a reasonable doubt before a judgment of guilt may be made.
