03/18/14  On Sunday, March 16th at 2:30 A.M. Bourbon Police Officer Matthew Geiger conducted a traffic stop on Lincoln Highway east of Elm Road.    23 year old Jeremy D. Schwartz of Nappanee was stopped for speeding.  Mr. Schwartz was the driver of a Ford truck and was found to be Operating While Intoxicated.   A field sobriety test was completed and Schwartz was transported to the Marshall County Jail and held on a $1,505 bond.  He was released later that morning at 11:20 A.M.   He was given a March 25th date to appear in Marshall Superior Court II for his initial hearing.

Readers are reminded that charging information supported by an affidavit of probable cause is a mere allegation that a crime has been committed and that there is only probable cause to believe a crime has been committed. They are presumed innocent throughout the proceedings and are entitled to be represented by counsel and entitled to a trial by jury at which the State is obligated to provide proof beyond a reasonable doubt before a judgment of guilt may be made.
