MugShot_Justin GreenJustin K. Green, 43 of Mishawaka was in Marshall Superior Court I Friday for consideration of a Plea Agreement.

Green was charged April 2017 for Reckless Homicide and Dealing in a Narcotic Drug as it related to the death of a man on Del-Lo-Me Lane who overdosed on the drugs supplied to him by the suspect.

Senior Judge Barbara J. Johnson presides over the hearing and the court made the following findings:  Count one Reckless Homicide was dismissed and Green was found guilty of count II, Dealing in a Narcotic Drug as a level 5 felony.  A fine of $1.00 and $185 in court costs, plus the $200 countermeasure fee was imposed.

The court considered the specific terms of the plea including the aggravating and mitigating factors including the death of the victim, the defendants criminal history, and the defendant’s violations of probation.  It was noted the aggravating factors outweighed the mitigating factors.  Justin Green was sentenced to 4 year in the Indiana Department of Correction He was ordered to complete any treatment programs offered by the Department of Corrections that will enable him to continue to address his severe substance abuse.

Mr. Green may request a modification of his sentence one he completes 2 year of actual prison time.

Green is to report to the Marshall County Jail on Monday, August 20th at 9 a.m.  Failure to report to the jail at the assigned time a Bench Warrant will be issued for his arrest.
