Local businessman Carl Stockberger was present for Tuesday night’s Plan Commission meeting. Stockberger’s business, CDS Mixers & Parts at the corner of Western Avenue and Pilgrim Lane has been a topic of conversation from concerned citizens who believe the “salvage yard” is a violation and eyesore.
During a discussion it was explained that Stockberger’s property is zoned C-3 commercial and a salvage yard would be a special use meaning it’s allowable but must have a review by the Board of Zoning Appeals who could also place conditions on the use including the requirement of shielding, fencing, limitations to size and hours of operation.
Mr. Stockberger said the property had been zoned heavy industrial but when the city opened up Pilgrim Lane for the Lowes Store they thought the proper zoning would be commercial. Stockberger did not fight the change in zoning.
Keith Hammonds, the city’s Building Commissioner explained to Stockberger that even in an industrial zone a salvage yard would need a special use.
Plan Commission president, Doug Feece said, “It only amounts to the legality of it.” He continued that he only wants Stockberger to seek a special use so citizens will quit complaining.
Stockberger questioned the city’s definition of a salvage yard saying his business is not a salvage yard.
City Attorney Sean Surrisi will look at the state statue and help resolve the debate of terminology on the business and report back to the Plan Commission.
