The Mill Pond Dam has three owners according to Roger Kottlowski from Commonwealth Engineers. Jewel and Lucile Bevil, the Lake Latonka Property Owners Association and Marshall County are the listed owners.
The Indiana Department of Natural Resources has given up the inspection and maintenance responsibilities. They have informed Marshall County that they will no longer inspect the dam.
Due to the fact that this dam has been determined to be a high hazard dam it requires a professional engineer to inspect the structure.
The most recent inspection was in 2009 by Bonar Engineering.
Commonwealth Engineer submitted a proposal for the inspection but the commissioners tabled any action until they can discuss the issue with the other two owners. It was suggested that they create a memorandum of understanding with the other Mill Pond Dam owners and have costs shared between the three of them.
