A request to check on two individuals in a vehicle parked in front of Handy Spot Liquor at 500 West Jefferson Street in Plymouth ended with two arrests. 

At about 8:30 p.m. Saturday, December 23rd, Plymouth Police officers were called to check on a vehicle with two individuals in it.  Officers arrived and decided to have Plymouth Fire/EMS come to the scene to medically check on both subjects. They men were transported to the Plymouth hospital for medical jail clearance. 

A DUI investigation was initiated on 39-year-old Alejandro N. Calix-Mencias of Lincolnway East in Plymouth. A search warrant was granted for a chemical test and Calix-Mencias was found to be over four times the legal limit for alcohol.

Wilmer J. Gutierrez Garcia, 38 East Jefferson Street and Calix-Mencias were both medically cleared and transported to the Marshall County Jail.

Mencias was booked in for OWI .15% or higher and Public Intoxication.

Garcia was booked in for Public Intoxication.

Readers are reminded that charging information supported by an affidavit of probable cause is a mere allegation that a crime has been committed and that there is only probable cause to believe a crime has been committed. They are presumed innocent throughout the proceedings and are entitled to be represented by counsel and entitled to a trial by jury at which the State is obligated to provide proof beyond a reasonable doubt before a judgment of guilt may be made.
