Officer Sammartano with the Marshall County Sheriff’s Department arrested a Warsaw man Sunday afternoon on multiple charges. 

On May 21st, at approximately 12:15, Officer Alex Truty with the Marshall County Sheriff’s Department was on regular duty patrol. The Marshall County Central Dispatch Center put out a report of a possible impaired driver southbound on U.S. 31 from the area of Veterans Parkway.

Officer Dan Sammartano with the Marshall County Sheriff’s Department located that vehicle and initiated a traffic stop at the Pilot Truck Stop at U.S. 30 and King Road. It was believed that the driver, 23-year-old Fabian Mar Sosa was intoxicated.

An investigation was initiated, and Mr. Sosa was arrested and booked into the Marshall County Jail for Operating While Intoxicated as a class A Misdemeanor, Neglect of a Dependent as a level 6 Felony, Possession of Marijuana as a class B Misdemeanor, and Driving While Suspended with a prior as a class A Misdemeanor.  Fabian Sosa was held on a $1,500 cash bond.

Readers are reminded that charging information supported by an affidavit of probable cause is merely an allegation that a crime has been committed and that there is only probable cause to believe a crime has been committed. They are presumed innocent throughout the proceedings and are entitled to be represented by counsel and entitled to a trial by jury at which the State is obligated to provide proof beyond a reasonable doubt before a judgment of guilt may be made.
