On Sunday, January 15th, 2023 at approximately 2:45 in the morning, Marshall County Police responded to a single vehicle unknown accident into a swamp area on 13th Road, just west of US 31.

Officer Wozniak located a black 2001 Dodge pickup truck that was half submerged in the water. The officer located a male subject in the driver’s seat and was able to assist him from the vehicle.

The driver, 30-year-old Christopher W. Brauneker of East Walnut Street in Argos, was found to be under the influence of alcohol. Field sobriety tests were completed, and a certified blood draw later showed his blood alcohol to be more than three times the legal limit.

Brauneker was transported to the Marshall County Jail and processed for Operating a vehicle with a BAC of .15 or more and Driving While Suspended with a prior conviction within 10 years.  He was held on a $1,500 cash bond. He bonded out just after 2 p.m. on January 15th.

Readers are reminded that charging information supported by an affidavit of probable cause is merely an allegation that a crime has been committed and that there is only probable cause to believe a crime has been committed. They are presumed innocent throughout the proceedings and are entitled to be represented by counsel and entitled to a trial by jury at which the State is obligated to provide proof beyond a reasonable doubt before a judgment of guilt may be made.
