On Saturday, August 6th, at approximately 3:30 in the morning, Marshall County Officer Wozniak initiated a traffic stop on a 2005 Yamaha moped in the area of 9A Road and Collins Drive.

The driver of the moped, 29-year-old Brandon J. Hattery of Elm Street in Nappanee, failed to comply with officers and threw an item into a yard, which was found to be a methamphetamine pipe with residue. 

Officers also found marijuana hidden on his person. Brandon was taken into custody and transported to the Marshall County Jail and processed for possession of methamphetamine, obstruction of justice, possession of marijuana, possession of paraphernalia, and resisting law enforcement and was given a cash bond of $1,500.00.

Readers are reminded that charging information supported by an affidavit of probable cause is merely an allegation that a crime has been committed and that there is only probable cause to believe a crime has been committed. They are presumed innocent throughout the proceedings and are entitled to be represented by counsel and entitled to a trial jury at which the State is obligated to provide proof beyond a reasonable doubt before a judgment of guilt may be made.
