On Monday, July 11th, at approximately 1:00 AM, Marshall County Police were notified of a possibly impaired vehicle traveling southbound on US 31 from the north County Line.

Officer Wozniak was able to locate the vehicle, described as a gray sport utility vehicle. The vehicle was stopped and the driver, 27-year-old Sergio Garcia Tulio of Indianapolis was found to be under the influence of alcohol. A certified test showed him to be more than two times the legal limit of alcohol.

Tulio was taken to the Marshall County Jail and processed for Operating a Vehicle While Intoxicated with a BAC of .15 or more, Operating a Vehicle while Intoxicated, and Operating a Vehicle Without ever receiving a driver’s License.  He was held on a $1,500 cash bond. 

Readers are reminded that charging information supported by an affidavit of probable cause is merely an allegation that a crime has been committed and that there is only probable cause to believe a crime has been committed. They are presumed innocent throughout the proceedings and are entitled to be represented by counsel and entitled to a trial by jury at which the State is obligated to provide proof beyond a reasonable doubt before a judgment of guilt may be made.
