On Thursday, May 5th, at approximately 6:00 AM, Marshall County Police and Plymouth Police were dispatched to the area of Olive Trail and Dixon Lake Trail for a single-vehicle accident.

Arriving on the scene, Marshall County Officers located a blue 2002 Honda Civic that had driven off the roadway into a guard rail and utility pole. The driver of the vehicle, 45-year-old Michael J. Fischer of Nataka Trail in Plymouth, was found to be under the influence of alcohol.

Field sobriety testing and a certified blood draw were completed, which showed Mr. Fischer to be over four times the legal limit of alcohol. He was transported to the Marshall County Jail and processed for operating a vehicle with a BAC of .15 or more and held on a $1,500 cash bond.  His bond was paid about 7:30 Thursday evening and he was released. 

Readers are reminded that charging information supported by an affidavit of probable cause is merely an allegation that a crime has been committed and that there is only probable cause to believe a crime has been committed. They are presumed innocent throughout the proceedings and are entitled to be represented by counsel and entitled to a trial jury at which the State is obligated to provide proof beyond a reasonable doubt before a judgment of guilt may be made.
