DUIOn Thursday, June 4th at 4:43 A.M. Marshall County Dispatch received a 911 call about a possibly impaired driver driving on US 31 in the area of 13th Road. Officer Wozniak with the Marshall County Sheriff’s Department located the vehicle and initiated a traffic stop on a 2005 Dodge mini-van in the area of US 31 and 9A Road. The driver of the vehicle identified as 56 year old, Dwayne Cohns of Gary was found to be under the influence of alcohol. A certified test showed him to be almost two times the legal limit of alcohol. Mr. Cohns taken into custody and transported to the Marshall County Jail and held on charges of Operating a Vehicle with a BAC of .15 or More and Operating a Vehicle While Intoxicated –Endangering.

Readers are reminded that charging information supported by an affidavit of probable cause is a mere allegation that a crime has been committed and that there is only probable cause to believe a crime has been committed. They are presumed innocent throughout the proceedings and are entitled to be represented by counsel and entitled to a trial by jury at which the State is obligated to provide proof beyond a reasonable doubt before a judgment of guilt may be made.
