County News # 1Last week the Marshall County Commissioners approved an amendment to the County Zoning Ordinance as it pertains to the Environmental Standards for Erosion.

County Plan Director Ty Adley presented a revised amendment after the commissioners denied the original amendment at a December 2019 meeting.  During the initial presentation Adley was seeking language that would require any construction which disturbs more than 4,000 square feet of cumulative surface area must comply with the county’s drainage and sediment control ordinance.

Commissioner Stan Klotz voiced concerns he had heard from various contractors about how difficult it is to build in the county due to all the regulations.

The denied ordinance amendment was sent back to the County Plan Commission for a revision and presented at the February 17th meeting to the commissioners again.  The new language states, “any construction which disturbs more than 4,000 square feet per project and or 6,000 square feet of cumulative surface must comply with the Marshall County Drainage and Sediment Control Ordinance.”

Prior to approval Commissioner Klotz asked about waivers and who would grant the waivers.  Adley assured him that waivers would be available depending on soil types and both the Plan Director and County Surveyor would have to approve the waiver.

No comments were received during the public hearing and the commissioners suspended the rules and passed the ordinance amendment on all three readings.
