superior DisposalSuperior Disposal Service of North Judson will receive a “Notice of Violation” from the Marshall County Solid Waste District Board.  During the meeting Monday, Marianne Peters Executive Director told board members that Superior Waste is reaching out to residential customers in the county with the curb-side trash program.  The issue is, they have suspended their curb-side recycling program.

Peters said the County Commissioners approved an ordinance in 1998 that required all residential, curb-side trash haulers to participate and offer recycling.  While the ordinance does not make it mandatory for residents to use the service the ordinance does not allow a trash hauler to offer any type of discount to residents who don’t recycle.

Peters told the board she spoke with a representative from Superior Disposal about a year-and-a-half ago in her office and informed them of the county ordinance on curb-side recycling.   At this point they are still seeking customers in Marshall County but don’t offer a recycling program for residential customers.

On Monday the Board of Director for Solid Waste motioned to have their attorney, Ken Lukenbill send a letter explaining the violation along with the “Notice of Violation”.  The ordinance permits a penalty of up to $300 per day of the violation.   The board did not address a penalty with the initial letter but they are asking Superior Disposal Services to cease and desist.
