BZA_CountyEarlier this month, the Marshall County Board of Zoning Appeals heard the request of Floyd Borkholder to allow a retail buggy sales location at 2525 Birch Road in Bremen, an agricultural zone.

Ty Adley, County Plan Director told member of the County BZA that the he received a complaint on the business and conducted an investigation.   He found the business to be in violation along with the sign for the business and recommended denial of the request for a Special Use variance.

Mr. Borkholder said he opened the business in June of 2018 and didn’t understand that he need a variance to permit the business in a Ag zone.

There was an existing garage on the property and Borkholder has added two accessory buildings.  He told the BZA he keeps the new buggies inside and the used ones outside.  The business is run by Floyd and his son.  The business is open from 2 to 6 Monday through Friday and 8-3 on Saturday.

The County BZA asked Mr. Borkholder what he sees for the business 5 years down the road.  Borkholder said he’s unsure but since there is no other buggy shop in the area he anticipated it growing.

The BZA unanimously approved the Special Use variance and will allow the business to be open from 8 to 6 Monday thru Friday.  They also told him he would have to apply for a variance to keep the current sign.
