Wednesday morning just before 2 the Marshall County Sheriff’s Department was dispatched to an overturned semi on US 30, just west of State Road 331.
Phillip Tolbert of Plainfield, IL was driving a 2007 Mack Semi truck and told Officer Prater he was trying to avoid a collision with a small white pickup truck that had passed him and was changing back into the driving lane but hadn’t completely passed the semi.
Tolbert swerved and traveled off the north side of US 30. As he attempted to maintain control of his vehicle and swerved to back onto the roadway when his semi overturned coming to rest on its side.
Listeners and readers are reminded that charging information supported by an affidavit of probable cause is merely an allegation that a crime has been committed and that there is only probable cause to believe a crime has been committed. They are presumed innocent throughout the proceedings and are entitled to be represented by counsel and entitled to a trial by jury at which the State is obligated to provide proof beyond a reasonable doubt before a judgment of guilt may be made.
