Neal_Haeck_4In March of 2016, following a two-day jury trial former Marshall County Highway Superintendent Neal Haeck was found guilty of a single count of theft as a class D felony.

During the trail Haeck never admitted to the thefts that were committed between early 2012 and late 2013.  The prosecutor showed receipts from a scraping business totaling just over $12,000.  There were no receipts showing that those funds were deposited into any account for the Marshall County.

Haeck and his South Bend Attorney, Stan Wruble filed an appeal and the Indiana Court of Appeals on Tuesday reversed the theft conviction.  In their decision the court said there was insufficient evidence of Haeck’s theft of over $12,000 from the sale of scrap metal.

The county will look at the ruling and make a decision within the next couple if they want to take the case on to the Indiana Supreme Court.
