To address this issue, State Senator Randy Head authored Senate Enrolled Act 353, which changes the law regarding home improvement contracts to cut down on the number of scams that occur. SEA 353 went into effect July 1.

Senator Head details the new protections:

  • Consumers may cancel a contract in writing before midnight on the third day after the contract has been signed or after they have received written notice from their insurance company that the contract is considered a covered loss.
  • Contracts must include an email address for the home improvement supplier and every owner, officer, employee or agent.
  • Consumers may now email their intent to cancel a contract.
  • Third party subcontractors or vendors may not initiate or pursue a claim with the insurance company of an insured consumer.

Senator Head said, “I am confident these new measures will help protect Hoosiers and make scams more difficult to carry out.”
