Saturday night just before 11, Officers Ryan Richey and Paul Stamper were working the Blueberry Festival. They were alerted of an intoxicated male that had fallen off of the swings at the playground behind the Blueberry security trailer.

 

The officers investigated and found 54 year old Leland Falter III to be intoxicated in public.

 

Mr. Falter was taken to the hospital where a jail clearance was obtained. He was then transported to the Marshall County Jail and lodged for Public Intoxication.

 

 

Listeners and readers are reminded that charging information supported by an affidavit of probable cause is merely an allegation that a crime has been committed and that there is only probable cause to believe a crime has been committed. They are presumed innocent throughout the proceedings and are entitled to be represented by counsel and entitled to a trial by jury at which the State is obligated to provide proof beyond a reasonable doubt before a judgment of guilt may be made.
