While working on Operation Pull Over, Bourbon Police Officer Rick Kanarr stopped an SUV traveling south on State Road 331 near 11th Road in excess of the posted 55 mph speed limit, radar confirmed the vehicle was traveling 66 mph.
The driver, 35 year old Javier Francisco of Warsaw was also found to not be wearing his seat-belt during the traffic stop. It was also learned that Francisco had never received a driver’s license.
Francisco was arrested and booked into the Marshall County Jail for speeding, failure to wear seat belt and operator never licensed and held on a $255 cash bond.
Listeners and readers are reminded that charging information supported by an affidavit of probable cause is merely an allegation that a crime has been committed and that there is only probable cause to believe a crime has been committed. They are presumed innocent throughout the proceedings and are entitled to be represented by counsel and entitled to a trial by jury at which the State is obligated to provide proof beyond a reasonable doubt before a judgment of guilt may be made.
