news_logoWTCA received the following information from public documents filed with the court.

Just after midnight on December 22nd 19 year old Fabian Romano Rubio of East Shore Drive in Bremen was arrested by Bremen Police.  He was lodged in the Marshall County Jail on a charge of Sexual Misconduct with a minor as a class C felony and rape as a class B felony.  He was initially held with no bond.

This case broke on December 21st when an informant contacted Bremen Police Officer Nicholas Spaid and advised that a mutual friend had information regarding 19 year old Fabian Rubio.  The additional information was from a separate and ongoing investigation.

During an investigation at the Bremen State Police Post the female told Officer Spaid that she had a prior sexual encounter with Rubio in June of this year when she was 15.  The unnamed juvenile told officers they had met through a mutual friend on social media and was with him about five times from the end of school until he left for the military at the end of June.

During one of the encounters Fabian Rubio drove the juvenile female around.  They parked in two different locations southwest of Bremen, one of them being the “Little Egypt Cemetery” and the second being the “Troll Bridge” on 5th Road.

It was the final encounter with Rubio where the then 15 year old juvenile alleges that Fabian Rubio raped her in her bedroom.

Through the investigation of 19 year old Fabian Rubio, officers learned of his advances on other young females through social media, some being younger that this victim.

Marshall County Prosecutor David Holmes believed probable cause existed for an arrest warrant and Judge Robert Bowen issued a warrant for his arrest with a count of rape and one for sexual misconduct with a minor.

The judge set the cash bond for Fabian Roman Rubio at $100,000.

The Prosecutor’s Office strongly emphasizes that these are only allegations and Mr. Rubio is presumed innocent unless proven guilty beyond a reasonable doubt in a court of law before a judge or jury of his peers
