04/30/14 On Friday, April 25th at 10:48 A.M. Plymouth Police Officer John Weir initiated a traffic stop on Michigan Street near Skylane Drive. The stop was for an expired license plate. Making contact with the driver, 47 year old Kimberly Ayala and running her information through the BMV it was found that she was a habitual traffic violator. She was taken into custody, transported to the Marshall County Jail and held on a $1,505 bond. Ayala was released later Friday afternoon after posting bond and received a May 27th Superior Court II date.
Later Friday night at 6:12 P.M. Officer Jeremy Enyart responded to Centier Bank at 537 North Oak Drive with the Plymouth EMS in reference to a female unresponsive sitting in a car in the parking lot. Officer Enyart arrived at the scene and located the female who was passed out in the vehicle. The officer was able to get the passed out female to sit up and respond to him. A strong odor commonly associated with the consumption of alcohol was coming from the female identified as 34 year old Michelle L. Dyniewski of Fowler. Plymouth EMS checked out Fowler and then a portable breath test was given. Dyniewski registered twice the legal limit and was taken into custody. During the inventory of her vehicle a small clear baggie was located containing marijuana along with two marijuana smoking devices. Dyniewski was transported to the County Jail and booked for operating while intoxicated, possession of marijuana and disorderly conduct and held on a $3,005 bond.
At 6:51 P.M. Friday, Officer Weir attempted to initiate a traffic stop on a white GMC Envoy for a traffic offense but the vehicle sped off. The vehicle was located in the Country Place Apartments and the driver identified as 20 year old Juan R Terrones of Texas. He was taken into custody transported to the County Jail and held for resisting law enforcement and operator never licensed. Terrones’ bond was set at $4,505 cash which was paid on Saturday. He was released the next day after posting bond and received a May 27th Superior Court II date.
On Saturday, April 26th at 3:45 P.M. Officer Bridget Hite responded to 322 Pennsylvania Avenue after being dispatched for a fight at the location. Officer Hite discovered that there had been an on-going dispute between neighbors. 40 year old David Cooper who resides at the residence was found to be intoxicated and was taken into custody. Mr. Cooper was held in the County Jail for public intoxication on a $1,005 bond. He was released on Monday, April 28th with no judicial review and received an May 13th Superior Court II date.
At 4:09 P.M. on Saturday Officer Benjamin McIntyre was dispatched to 322 Pennsylvania Avenue for a battery. A female at the scene identified as 33 year old Amber F. Tapia of Bourbon was found to have an active warrant through Marshall County for civil contempt. She was taken into custody and transported to the Marshall County Jail and held on a $5,000 bond.
On Sunday, April 27th at 12:40 P.M. Officer Bob DeLee responded to the 800 block of North Plum Street after a report from a female that 30 year old Juan Luva of Plymouth had forced his way into her residence and took her phone. Officer DeLee arrived at the location and Mr. Luva was located and taken into custody for burglary, residential entry, theft and interfering with reporting a crime. He was transported to the Marshall County Jail and held on no bond.
Readers are reminded that charging information supported by an affidavit of probable cause is a mere allegation that a crime has been committed and that there is only probable cause to believe a crime has been committed. They are presumed innocent throughout the proceedings and are entitled to be represented by counsel and entitled to a trial by jury at which the State is obligated to provide proof beyond a reasonable doubt before a judgment of guilt may be made.
