10/21/10 The Marshall County Alcohol Beverage Commission will consider the permit of the Family Express Corporation for a 115 Grocery Permit at their store at 1628 West Jefferson Street in Plymouth.

The Gas Station/Convenience Store would be the second in Marshall County to sell alcohol if the permit is granted. A few years ago the Bourbon Gas Station applied for a 115 Grocery Permit.  The local Alcohol Beverage Board denied the application but the State Alcohol Board overruled their decision.

The first step to acquiring an alcoholic beverage license is to determine if there is one available in the area in which the business intends to operate from.  Once it has been determined the type of license needed is available, the Alcohol & Tobacco Commission sends the necessary forms.

Once the forms and fees are submitted for the new permit application the process may take as long as 10 to 12 weeks.   The applicant then will appear before the local alcoholic beverage board for their recommendation.  The Marshall County Board will meet Monday, November 1st at 10 a.m. in room 207 of the County Building on the Family Express application.

At this meeting the permit will be brought up for consideration by the four-member panel composed of three locally appointed residents of the county and an Indiana State Excise Police officer.  Local board members are Vida Creed of Plymouth, Maria Keller of Bourbon and Kate May of Culver.

Residents of the area are allowed to speak for or against the granting of the permit during the public meeting.  The local board makes their decision based on several factors which are specifically spelled out in the Alcoholic Beverage Code of the State of Indiana.

Voting on the local board’s recommendation by the State Alcohol & Tobacco Commission members is the first Tuesday of each month.  Following their favorable recommendation the State Excise Police will submit their final inspection of the premises.

Either side has the right to appeal the Local Board decision to the State Alcohol & Tobacco Commission within fifteen (15) days.
