A South Bend man was arrested on Thursday night December 15th following a traffic accident.
At approximately 10:40 P.M. Marshall County Central Dispatch received a phone call about a vehicle that had driven off the road on US 31 in the area of 5A Road.
Marshall County Police responded to the scene. Deputy Templeman spoke with the driver of the vehicle, identified as 31-year-old Kenneth Rose-Rustman of South Bend, and believed him to be under the influence of alcohol. The deputy conducted field sobriety tests and determined him to be intoxicated.
Kenneth Rose-Rustman was transported to the Marshall County Jail where he was booked and charged with Operating a Motor Vehicle While Intoxicated with a BAC above .15, and for Operating a Motor Vehicle While Intoxicated Endangerment. He was held on a $1,500 cash bond until Friday afternoon at 1 when his bond was paid and he was released.
Readers are reminded that charging information supported by an affidavit of probable cause is merely an allegation that a crime has been committed and that there is only probable cause to believe a crime has been committed. They are presumed innocent throughout the proceedings and are entitled to be represented by counsel and entitled to a trial jury at which the State is obligated to provide proof beyond a reasonable doubt before a judgment of guilt may be made.
