On Friday, September 17th at approximately 11:00 PM, Officer Wozniak with the Marshall County Sheriff’s Department initiated a traffic stop on a silver 2011 Hyundai in the area of West Jefferson Street and North Fifth Street in Plymouth.

During the investigation, the driver of the vehicle, 24-year-old Blake E. Harker of Plymouth was found to be over two times the legal limit of alcohol.

Harker was transported to the Marshall County Jail and charged with Operating a Vehicle with a BAC of .15 or more, Operating a vehicle While Intoxicated Endangering and Operating a vehicle While Intoxicated with a prior conviction.  Harker was given a cash bond of $1,500 and an initial hearing in Marshall Superior Court II of September 28th.

Readers are reminded that charging information supported by an affidavit of probable cause is merely an allegation that a crime has been committed and that there is only probable cause to believe a crime has been committed. They are presumed innocent throughout the proceedings and are entitled to be represented by counsel and entitled to a trial jury at which the State is obligated to provide proof beyond a reasonable doubt before a judgment of guilt may be made.
