On Saturday, April 24th, at 2:54 a.m. Officer Wozniak with the Marshall County Sheriff’s Department was dispatched to a property damage accident in the area of mile marker 234 on U.S. 31.
During the investigation, the officer found 31-year-old Anthony D. Moyer of Elkhart behind the wheel of a blue 2005 Chevrolet Trailblazer attempting to leave the scene.
Moyer was found to be impaired and transported to Plymouth Hospital for a certified test. He was later taken to the Marshall County Jail for operating a vehicle while intoxicated on a controlled substance and operating a vehicle while intoxicated endangering. Moyer was held on a $1,500 cash bond that was paid about 3:30 Monday morning. He was released with an initial court hearing in Marshall Superior Court II on May 11th.
Readers are reminded that charging information supported by an affidavit of probable cause is merely an allegation that a crime has been committed and that there is only probable cause to believe a crime has been committed. They are presumed innocent throughout the proceedings and are entitled to be represented by counsel and entitled to a trial jury at which the State is obligated to provide proof beyond a reasonable doubt before a judgment of guilt may be made.
