Last Thursday, January 18th Marshall County Deputy Matt Geiger responded to a single-vehicle accident on U.S. 31 at 9A Road.  The incident happened at about 12:45 in the morning.

The driver of the vehicle, 22-year-old Lance D. Miller of Rochester, had not stopped at the stop sign at 9A and U.S. 31. The vehicle crossed over the median causing damage to the vehicle.

It was suspected that Mr. Miller had been drinking.  He was transported to the Plymouth hospital to be checked out and for testing.

Lance Miller had a blood alcohol level of .114% and was arrested for operating a vehicle while intoxicated. Mr. Miller was given a court date and a cash bond of $1500.

Readers are reminded that charging information supported by an affidavit of probable cause is merely an allegation that a crime has been committed and that there is only probable cause to believe a crime has been committed. They are presumed innocent throughout the proceedings and are entitled to be represented by counsel and entitled to a trial by jury at which the State is obligated to provide proof beyond a reasonable doubt before a judgment of guilt may be made.
