A call to the Marshall County Central Dispatch Center at 11:30 Tuesday morning, September 5th for an out-of-control subject in the 1500 block of West Harrison Street sent officers from the Plymouth Police Department in response.

Officer Wally Derifield conducted an investigation of the incident that took place inside a residence.

The result of his investigation was the arrest of Timothy Binion, 45, who lives at 1503 West Harrison Street.  Binion was incarcerated in the Marshall County Jail for Resisting Law Enforcement, Public Intoxication, Intimidation, and Disorderly Conduct.   He was held on a $1,500 cash bond.

Readers are reminded that charging information supported by an affidavit of probable cause is a mere allegation that a crime has been committed and that there is only probable cause to believe a crime has been committed. They are presumed innocent throughout the proceedings and are entitled to be represented by counsel and entitled to a trial by jury at which the State is obligated to provide proof beyond a reasonable doubt before a judgment of guilt may be made.
