Jim Clevenger, County Attorney told the County Commissioners on Tuesday his opinion is that the Planned Unit Development (PUD) of Adventura at 3919 North Michigan Road has not been approved, rejected, or sent back to the Plan Commission for revision.  He said the law states that if the commissioners don’t take official action then the PUD requested by the developer can proceed.

The Commissioners approved the PUD ordinance on first reading with a 2-0 vote with one commissioner absent.  The PUD allows for the development of an upscale, gated community with 33 shipping container homes.  The commissioners failed to approve the PUD on second reading with a 1-1 vote with one commissioner absent. Clevenger said, “The status is the commissioners have not approved, rejected, or sent back the amendment for further consideration to the Plan Commission.” 

With all three commissioners present at Tuesday’s meeting, Commissioner Kevin Overmyer stated that he had seen paperwork from the Department of Health for the septic and water supply at the proposed development which answered their questions. 

Commissioner Mike Burroughs motioned to approve the PUD as presented with proof of the septic and water systems.  It was seconded by Commissioner Overmyer and the vote was 2-1 with Commissioner Stan Klotz voting in opposition.    

The commissioners will have the third and final reading on September 18th
