Plymouth Police responded to the area of Oak Road and Lake Avenue for the two-vehicle crash Wednesday, August 16th just before 9 p.m.

During the investigation, it was believed that one of the drivers was under the influence. 

An officer with the Plymouth Police Department conducted an investigation that determined the female driver identified as Cristen Birk, 32, of the 400 block of North Center Street in Plymouth was intoxicated.  As a result of the officer’s investigation, Birk was taken into custody and transported to the Marshall County Jail. 

Cristen Birk was booked on criminal charges of Operating While Intoxicated-Endangering, Operating While Intoxicated on a Controlled Substance, and Possession of a Legend Drug.

Her cash bond was set at $1,500 and Birk was released at 11:54 a.m. on Thursday, August 17th.   

Readers are reminded that charging information supported by an affidavit of probable cause is a mere allegation that a crime has been committed and that there is only probable cause to believe a crime has been committed. They are presumed innocent throughout the proceedings and are entitled to be represented by counsel and entitled to a trial by jury at which the State is obligated to provide proof beyond a reasonable doubt before a judgment of guilt may be made.
