DUIOn Saturday, June 6th at approximately 2:02 P.M. Marshall County Sheriff`s Deputy Bragg conducted a traffic stop on a vehicle in the area of Plymouth Laporte Trail and 6th Road. During the course of the investigation it was determined the driver of the vehicle identified as 53 year old, James J. Smith of Walkerton was intoxicated. Mr. Smith was taken into custody and transported to the Marshall County Jail where he was held on charges of Operating While Intoxicated – Endangering and Operating While Intoxicated with a BAC 0.08% or more.
Readers are reminded that charging information supported by an affidavit of probable cause is a mere allegation that a crime has been committed and that there is only probable cause to believe a crime has been committed. They are presumed innocent throughout the proceedings and are entitled to be represented by counsel and entitled to a trial by jury at which the State is obligated to provide proof beyond a reasonable doubt before a judgment of guilt may be made.
